TERMS AND CONDITIONS

  1. Delivery and Return

The vehicle is delivered to the Renter in good overall condition and without apparent defects. Any complaints as to its condition must be made to the Lessor immediately upon delivery during the inspection. The Renter agrees to return the vehicle with all documents and accessories and in the same condition to the Lessor and at the location and on the date designated in this agreement. The Lessor reserves the right to repossess the vehicle without demand at Renter’s expense if vehicle is used in violation of this agreement.

 

  1. Damage, Loss, Theft etc.

In the event of damages to or loss of the vehicle or parts of it, including fire and/or breakage of glass, damages to tyres and/or tyre rings, damages to upholstery and/or interior, the Renter shall, irrespective of his or the driver’s fault, pay to the Lessor the amount of all resulting loss and expenses of the Lessor (including but not limited to replacement or recovery costs, repair costs, compensation for decline in value and loss of the rental fee). If the Renter or the driver violated these Standard Terms and Conditions of Rental, any legal provisions (also customs regulations or insurance regulations) as loss of revenue, the Lessor may charge a compensation corresponding to the rental charge, until the day the vehicle or a replacement vehicle will again be available to the Lessor. This liability of the Renter may be waived if renter accepts Loss Damage Waiver according to Clause 10 by placing his signature in the space “Accept” on the front page, provided that the renter complies in all other respects with the terms and conditions of this Rental Agreement.

 

  1. Charges

Renter Shall pay any charges shown on the page or according to current tariffs.

  1. a) Security Deposit (Cash/Card) will be released 28 days from the return date of the vehicle. For Cash and Purchased Deposits clients will bear any charges related to the refund. The Lessor bares no responsibility for Renter’s bank conversion rates.
  2. b) The Renter must pay all the expenses: damage, Salik toll gates, traffic fines, fuel, extra mileage. If the charges are more than 30% of deposit the Renter shall pay during vehicle return.
  3. c) Admin fee is applicable on all traffic fines occurred during the rental period.

 

  1. Mileage

Daily rentals are limited to 300 KM per day. Weekly rentals are limited to 200 km per day. Monthly rentals are limited to 5000 KM per month. Charges are applicable to excess mileage.

 

  1. Indemnity

The Lessor is only responsible for loss or damage suffered by Renter or Third Parties, in connection with the renting or the rented car, where such loss or damage was caused intentionally or through gross negligence on Lessor’s part. In all other cases, the Lessor cannot accept any such liability and

Renter shall hold the Lessor immune against such claims.

 

  1. Accidents, Thefts

In case of an accident (with or without damage to the vehicle), any personal injuries, theft of the vehicle or any parts of it, the police must be called to the scene of the event and Renter must insist on obtaining a “Police Report”. Any accident/damage/loss/theft of the vehicle must be reported to the Lessor immediately. Upon request of the Lessor, an accident report must be completed. Renter must secure all data of all involved parties including witnesses in order to complete accident report.

Under no circumstances, claims or offers by third parties must be accepted by the Renter. The Renter is obliged to assist the Lessor and/or its insurance companies in all claims or legal affairs in connection with an accident/any damage/theft of the vehicle or it’s parts. No repairs are to be carried out on the vehicle without the prior approval of Lessor. If the Renter violates any of these regulations, especially if no “Police Report” can be presented to the Lessor, even an accepted and paid LDW may not release Renter from indemnities. It is mandatory for the Renter of the vehicle to obtain “Police Report” and if it is not in a position to identify a third party, NOMAD RENT A CAR L.L.C reserves the right to recover the excess liability (AED 5000) from the Renter. Customers are responsible for tire damages and punctures, damage and breakage to glass, damage to upholstery.

 

  1. Personal Data

The Renter acknowledges the person-related data to this rental agreement is an automated process. The Renter expressly that such data can be communicated to third parties, especially for credit protection purposes.

 

  1. Governing Law and Jurisdiction

This Agreement shall in all respects be governed by, construed and interpreted and take effect in accordance with the law of the United Arab Emirates applicable to the Emirate where it is executed, and the parties hereto irrevocably submit to the non-exclusive jurisdiction of the courts of such Emirate.

 

  1. Loss Damage Waiver

By placing his initials in the space “Accept’ on the front page obligation to payment of a supplementary fee in accordance with currently valid price lists, Otherwise in case of damages to or loss or theft of the vehicle or parts of it, Renter assumes the obligation to payment of a supplementary fee in accordance with currently valid price lists. Otherwise in case of damages to or

loss or theft of the vehicle or parts of it, Renter shall be liable in accordance with Clause 2 of these Standard Terms and Conditions of Rental. The Loss Damage Waiver does not exempt from liability in case of gross negligence or deliberate contravention of the rental conditions, legal regulations or insurance conditions.

 

  1. Personal Accident Coverage

By placing his initials in the space “PAC” on the front page, Renter agrees to pay an additional fee as

per valid price lists, hereby, Renter acquires a personal accident coverage shown as per valid price lists

 

  1. Language

In the event of conflict between the text of this Agreement in English language and the text of this Agreement in Arabic language or any other Arabic translation and any competent court determining that such Arabic text or translation shall prevail, it is agreed the English text of this Agreement shall nevertheless be used to assist in any interpretation.

 

  1. Cancellation Policy
  2. a) If the customer cancels the reservation 7 days or more before the trip, 100% of the rental price will be refunded.
  3. b) If the customer cancels the booking 3-7 days before the trip, 90% of the rental price will be refunded
  4. C) If the customer cancels the booking 1-3 days before the trip, 50% of the rental price will be refunded
  5. d) If the client cancels less than 24 hours before the trip, 0% of the rental price will be refunded.
What do I need to rent a car?

 

You will need the following documents:

 

  • passport
  • Driving License
  • Bank card (for the security deposit)
  • Minimum age of 21 years old
Can anyone else drive the car I rent?

The contract prescribes two drivers, but at the time of filling out the contract, you must provide a driver’s license and passport.

What is not covered by insurance?

The costs for damages such as fire and/or breakage of glass, damages to tyres and/or tyre rings, damages to upholstery and/or interior, or everything that is not fixated by a police report (in the case of video evidence) are collected from the client and are not covered by insurance.

What to do in case of the accident?
  1. Do not move the car under any circumstances and go into a safe position (make a video of the incident and the damages if possible).
  2. Call the police ( “999 “)
  3. Inform the company.

 

What is the cost for crossing Salik gate?

There is a fee of AED 5 when crossing road tolls, also known as Salik. Customers don’t have to do any on their own, it will be charged from the deposit at the end of the trip.

What happens if I accidentally make a traffic violation?

If a customer violates a traffic rule, a fine will be issued. It is the responsibility of the driver to pay the fine. Speed limits are clearly signposted on most roads. We recommend staying within the speed limit at all times.

What kind of gasoline to fill in the car?

There are two types of gasoline at the U.A.E gasoline stations – Super (98) and Special (95). At the gas station the attendant will assist you and collect the payment (cash or card).

How much is parking in the UAE?

 

There are few types of parking in the UAE:

 

  • Shopping malls and mainly all sightseeing places usually have free parking.
  • Hotels and restaurants offer valet parking. This service can be either free or paid.
  • There are paid parking zones on city streets. The cost of an hour starts at 2 AED ($ 0.55).

 

How to pay I pay for parking in the UAE?

If you use paid parking, you can pay for the service in two ways:

 

  • By parking machine (for tourists) – insert the required number of coins, get the receipt, which must be placed under the glass of the car so that it can be seen.
